Since the late 20th Century, responding to hate crime has been a stated priority for the criminal justice system in England and Wales. This discussi- on examines the development of the concept of hate crime over this peri- od and how it has been integrated within criminal justice practice and broader policy measures. It pays particular attention to the manner in which elites divorce forms of violence from their wider political contexts and the structural conditions which sustain them. Exploring how this can reduce understandings of violence to that of individual pathology, it sug- gests that the state’s definitions of hate crime and its responses raise questions and challenges which progressive movements need to meet.
